The original position, contractualism and "institutional Transcendentalism": the new criticism of Sen to Rawls

Abstract

The article seeks to investigate the recent critical contribution of Indian economist Amartya Sen to the work of North-American political philosopher John Rawls, both of whom have been interlocutors for a long time. Sen renews the debate with the latter in his most recent book, The Idea of Justice, where he goes back to the discussion with Rawls to demonstrate what he understands as the manifested limitations of the procedures used by the philosopher to construct his theory of justice, notably the mechanism of the original position. With this work, I intend to demonstrate the limitations of Sen’s own critique. In order to do this, I shall discuss specific points of Rawls’s work.
