Objective civil liability for work-related health damages

The environment, including that of work , is considered a basic right guaranteed by Magna Carta (article 7º, XXII, section 225, caption and article 200, VIII) . The social value of work represents the pillars of Economic Order (article 170, CF) and Social Order (article 193, CF), which offers full health and physical integrity protection to workers in their working environment. Thus, the question of work-related damages suffered by employees due to industrial accidents and occupational hazards must be analyzed within the work environment protection legal context , adopting the objective civil liability theory, by means of a teleologic logical-systematic interpretation of constitutional and infra-constitutional rules. This interpretation evidences the compatibility of the economic activity and the free initiative according to the Democratic State of Right, in order to build a more just and united society , thus reducing social inequalities.
