Differences between the relationship of labor and the relationship of consumption in new competence matters of the labor court

The Constitutional Amendment n. 45/04 benefited the Labor Court by promoting deep changes in its material competency, from litigation analysis to judgments involving job relations , as well as other controversies caused by this relation. Whenever supported by the law, the Judiciary becomes the competent body to analyze all work related litigations. The question whether legal consumption relations are within the scope of the expression “ work relations” as expressed in the Consumer’s Defense Law ( Law 8.078/90), and filled under article 114 of the Federal Constitution has not been answered yet.. The general objective of this article was to analyze the evolution of the Labor Court, from its origins to the Constitutional Amendment n. 45/04. The specific objective was to demonstrate that legal consumption relations are not under the new material competence of the Labor Court, regarding consumption litigations.
