Abstract

With the inauguration of the Civil Code of 2002, the Brazilian legal system welcomed the principles of good faith in its objective form and the contract's social duty. Likewise, this study aims to answer - through the deductive and the bibliographical methods - the question: what was post-positivism's influence and role when the introduction of these principles were finally made into law in the Brazilian legislation.
