Abstract

The work seeks to expose part of the reflections elucidated in the research project "Government and Business Relations: philosophical and legal dialogues on the state regulation of the national economic order" which, in its initial stage addressed philosophical aspects about the law and the state. Thus, it seeks to demonstrate two models are at opposite poles: republicanism and liberalism, approaching its limits in relation to society, the law and the economy. So, it is noted, in conclusion, the need to relate both models in view of social reality and state function. With the introduction of thinking the fruit of social theory, it was possible to realize the need to relate both theories, since each has limits that must be observed. Thus, we intend to analyze certain aspects of complementary form, which triggered the search by the thought of Jürgen Habermas, which seeks to reconcile the private sphere to the public sphere of the subject, since it is possible to observe the existence of both and according with the need to relate them.
