The relativization of sovereignty in favor of the human rights

Abstract

This study analyzes the new concept of sovereignty that was formed with the affirmation of human rights in the international community. The emergence of international courts as a control mechanism of the signed treaties to promote human rights proved to be an important factor in the evolution of this concept. Thus, the accomplishment of the international judgments by the brazilian State gives effect to the human rights and, therefore, it must seeks the most appropriate way to do so according to the national legal system.
