Abstract

The article investigates the influence of the transnational legal discourse in the delimitation of an identity expression of legal-constitutional matrix. The study is based, therefore, on a pluralist conception of identity, based on the doctrine of Michel Rosenfeld. This allowed the researchers to formulate reflections on the influence of the legal discourse of the Inter-American Court of
Human Rights on the constitutional identity of the Member States of
the Inter-American Regional System. In this sense, Carl Schmitt’s
and Michel Rosenfeld’s dogmatics are reviewed, arguing the inadequacy of Schmitt’s perspective to the transnational context. To operationalize the research, the Brazilian case of transnationalization of constitutional identity is evaluated, highlighting the ideological nature of the restrictions to the internalization of the inter-American legal discourse in the national context. The research was developed according to a qualitative and descriptive approach, supported by a deductive method and through a bibliographical review and documental research. The concept formation technique is also part of the methodological substrate of the research, given the ambition of the researchers to present a new interpretation of the term constitutional identity.
