The constitutional principle of the national character of political parties and verticalization of coalitions

Abstract

This article is about an analyze the linkage of party coalitions in state elections and municipal guidelines coalitions held in national election President of the Republic, the "verticalization" of electoral coalitions; and yours relationship with the constitutional principle of the national character of political parties. The issue has become controversial with the issuance of Resolution no. 20993/2002 TSE, claiming the rule of verticalization of coalitions for purposes election. To avoid new interpretations, the National Congress, through the EC no. 52/2006 modified the art. 17, paragraph 1 of the Constitution, and pushed that interpretation TSE. The Supreme Court did not comment on the merits of the controversy over the possibility of vertical front of the constitutional principles that guide the political parties; as the precept of the national character set in art. 17; item I the CF. We seek in this study show that the national character of the parties, the training of electoral alliances; presupposes that they have unit in their ideologies, not to turn the coalition into mere instruments convenient to reach power. In this sense, one sees that the EC no. 52/2006 came against the conclusions of debates and studies around the Bill No.. 2,679 / 03; which you want to restrict the use of coalitions only the elections for President of the Republic; as a containment measure party fragmentation in the country and the lack of clear ideologies in our parties politicians.
