Abstract

This study has the objective to analyze the differentiated disciplinary regime. Initially, it presents the historical context in which it arose this type of sanction discipline, to then enter in your concept, where it was necessary using the Executive Criminal Law, especially with regard to their Articles 52 and 54 dealing specifically regime under discussion. At sequence, the doctrinal positions are listed and judicial decisions concerning the implementation of the differentiated disciplinary regime in the penitentiary system Brazil, highlighting the arguments used by different positions mentioned.
