Abstract

The dignity of the human person is the foundation of democratic rule of law, the Federative Republic of Brazil and supply value of the legal system. It turns out that the open nature of the terminology dignity creates the feeling of uncertainty and insecurity, fostering a wide doctrinal discussion regarding this issue. Dignity comes before the legal assertiveness and involves complex issues that can not be encompassed in a satisfactory manner by the law. Therefore this paper seeks to demonstrate the importance of philosophical and legal dialogue in addresing the constitutional value in analysis.
