Abstract

Points out the unconstitutionality of § 1 of Article 2 of Law 8,072 / 90, examining, initially, the separation of powers in the Federative Republic of Brazil and passing, below, the examination of the fundamental guarantee of a person sentenced to deprivation of liberty to be correct and proportionally individualized his sentence, and the correlated sequence the three levels of individualization of punishment to the corresponding branches of government, and bringing lastly, the preponderant role of the judiciary as guarantor of the observance of this right because of the possibility of interference with the other powers.
