Electronic mail monitoring in the work environment: the conflict between the employer’s directive power and his/her employee’s privacy right

The purpose of this article is to deal with the monitoring practiced by entrepreneurs as to the use of information technologies by their representatives in the work environment, which was enabled by the technological revolution originated in the globalization process. The theme in study also includes the confrontation of constitutionally assured rights in the employer/employee relationship and the position adopted by the courts concerning this problem.
