The inevitable disclosure doctrine and its applicability under the Brazilian legal system

Abstract

This article aims to explain the importance of trade secrets as intangible assets in business negotiations and their protection. In this context, it will seek to understand what constitutes the protection of trade secrets and, more precisely, if the doctrine of inevitable disclosure, which has been applied by US courts preventing free movement of workers between competing companies, to finally analyze its applicability in the Brazilian system.
