It analyzes the phenomenon of positivation of Culturalism in the Civil Code of 2002, through the study of Law, values, culture and Miguel Reale's though about culturalism. It presents introductory studies about the theory of the knowledge, the knowledge on the values and its importance to know the legal-private regimen constructed to be the source of the legal interpretation. The clarification on the changes is important instrument to face the challenges contemporaries in the plan of the intersubjetivas relations tutored by the Rights, in a society of sped up development.
