The writ of prevention’s main task is to provide actual protection in emergency cases. It imposes a big deal of care to judges, attorneys and public prosecutors, while dealing in such circunstances. This essay alerts that a misuse of principles and categories as well as a misuse of the so called modus operandi, can bring as a deep consequence, the annulment of the writ of prevention’s practical advantages, conceived due to the urgency of the pleading.
