Abstract

The controversy between Kelsen and
Schmitt about the role of law shaping
society and its relationship with political,
economic, and social powers are well
known in academia. In On the Three
Types of Legal Thinking, Schmitt strongly
criticizes Kelsenian positivism because
its formalism leads to a detachment
between social reality and the legal norm.
At the end of his study, Schmitt
concludes that positivism should be
transcended and indicates as proof of his
statement the proliferation of general
clauses in legal texts, defending that such
clauses enable not only the introduction
of social values in law, but also the
construction of a completely new model
of legal thought. The objective of this
paper is to analyze the Schmittian defense
of general clauses, especially in regards
to their function and role in law.
Furthermore, the purpose of this article is
to take a new look at the Brazilian
treatment of general clauses, utilizing
Schmitt’s vision in order to question the
emancipatory bias that is currently
attributed to them.
