Brazilian sanitary federalism: analysis of the municipal entity and the impact on health law

The State has difficulties guaranteeing the right to health, since there are problems involving the distribution of competences - especially due to the configuration of our cooperative federalism - and the finitude of resources - which makes it difficult to guarantee the universality of this right. This paper evaluates the configuration of sanitary federalism from the distribution of resources directed to municipalities. From this investigation, this study tries to understand the Brazilian federative design and the distribution of resources directed to health care in order to characterize or not the municipality as a de facto federated entity. Finally, this research identifies the extent to which health federalism can be mentioned as the economies of the municipalities of the country are maintained by transfers of health resources from the Union. As a methodology, a qualitative approach was performed due to the essential link. between the material under study and the theme in question. Regarding the technical procedures, bibliographic and documentary research were used.
