Abstract

The Brazilian State, as an Entrepreneur, can play a strategic role in the conduct and control of productive activities related to the exploitation of gold, in the current "global" conjuncture, in order to implement national sovereignty and the economic development of the nation. On the other hand, the activity of mining reveals itself, mainly in Brazil, throughout all the years of its existence, from the colonial phase until today, as one of its main products, although in the condition of commodity, responsible for positive results in our trade balance. This essay's investigation has as its central object the constitutional possibility of the State intervening directly in the economic domain, as a businessman, in gold mining, by relevant collective interest, aiming to use gold as a foreign exchange reserve and international means of payment by the State. This research is of a bibliographic and documental nature, possessing as its theoretical reference the theme of state intervention in the economic domain from the perspective of Washington Albino Peluso de Souza, as well as the distinction of state action and intervention in the economic domain from the view of Eros Roberto Grau.
