Between the classic and the contemporary: a (re) lecture of historical foundations of the constitutional law compared

Abstract

The present paper has the purpose to play a brief rescue of the origin and development of comparative constitutional law, giving attention to what characterizes it in modern times. In such a context, it cares to demonstrate that it is not a discipline that emerged recently, although on account of several factors, interest in it has varied over time. In view of this, what intends to present is that, at this recent days, the use of foreign constitutional references by supreme courts, very mindful caused by recent processes of globalization and proliferation of written constitution, was responsible for both resurrecting academic interest in comparative constitutional law, as to renew the questions inherent to it.
