Abstract

This work has the scope to debate within the legal theory, the environmental issues, in view of the need for a positive and urgent action of the whole society. First, it will be talk about the possibility of overcoming the tension between development and environmental protection, pointing some contributions of discourse theory of law Jürgen Habermas.
