This work has the scope to debate within the legal theory, the environmental issues, in view of the need for a positive and urgent action of the whole society. First, it will be talk about the possibility of overcoming the tension between development and environmental protection, pointing some contributions of discourse theory of law Jürgen Habermas. In then presents this theory and defends his emancipatory bias when raises the involvement of all sectors of society in the creation of law and formation of ecological decisions. It also highlights the role of the company and consumer in this process. Finally, bring the theory to safety legal.Downloads
