Abstract

This paper aims to demonstrate that Article 66 inserted in the Consumer Protection Code does not have the range needed to determine an effective punishment for causing the damage agent. Thus, the criminal law is attached to a symbolic value in the ratio of consumption, thus causing legal uncertainty. It will be checked abuse to non-compliance with the Minimum Intervention Principle, which causes unnecessary wear to the criminal law that should bring as ultima ratio. Since, there is the technical note of caution mainly of a criminal offense and the lack of penal law, is that inquires about the implementation of the Administrative Law Sanctioning as a means of solution of the problem.
