Abstract

Undeniable observe the importance of philosophy in modern nature sciences as well as in the law. Therefore, it becomes imperative to highlight the remarkable philosophical implications in the contemporary theory of law as well as the proximity between the general theory of law and philosophy presenting a proposal for a comprehensive overview of the legal phenomenon, rebuilding concepts and law institutes. So, the general theory of law aims to highlight the essential elements that dominate the development of law promoting the improvement of social relations by formulating fair rules and applying them equitably not forgetting the creation process of rules and their interpretations, as well as the classification of legal facts, theory buiding and development of principles, always with the constant care to ensure legal certainty with a view to building a democratic state of law.
