Abstract

This article reconstructs the distinction between rules and principles as species of standards in the work theory right philosopher Robert Alexy fundamental rights. It emphasizes the distinction from the aspect of normative antinomy, applying the thought of Alexy in the rules of conflict resolution and collision principles into concrete chances.

Graduado em Direito pela Faculdade de Direito de São Bernardo do Campo (1992-1996). Especialista em Direito Tributário pela Pontifícia Universidade Católica de São Paulo - PUC/SP (1999-2000). Aluno do 2º ano de Filosofia na Universidade Estadual de Londrina - UEL(2008). Juiz Federal Substituto da 2ª Vara Federal em Londrina.
