Abstract

This article presents a work that had the scope to question the effectiveness of the right to housing rifgt front of foreigners residing in Brazil, not excluding those who are in the country unlawfully. For this, it is necessary first of all examine the legal protection to housing in quality and under the ownership of human and fundamental rights there provided. Later, it was observed facets of state action as the promotion of adequate housing to foreigners, implemented through inefficient public housing policies, iun which the object determined should be the realization of the housing right. After such analysis, seeks to reflect on the factual and legal consequences of restrictions on foreign access to housing programs. Therefore, it was found that due to certain erroneous conduction of the problem, foreigners end up living on the margins of society and thus become more vulnerable to the challenges to fit into a new reality, endowed with prejudice, discrimination and lack of opportunities, that is, a cruel reality, far from guaranteeing the rights, in fact, foreign.
