The studied topic here, although without the pretension of setting an end to the subject, tries to show the elements that characterize the relation of the commercial representation (autonomous work) and the contract of work (subordinate work). The existence of problems is based on the existence of "gray zones or conflict zones" which comes out when there is an attempt to distinguish the juridical relation between autonomy and subordination. In conclusion, due to the fact that the magistrate is the only person who is a able to make decisions, since the law gives him this power, on/y he, based on facts and proofs which are shown in the process, is capable of doing this distinction between these two juridical relations (autonomous and subordinate work) using his own free will.
