Analisamos a possibilidade de homologação arbitral do plano de recuperação extrajudicial de empresas, tendo em vista a edição da lei n.11.101/2005 e a adoção do princípio da preservação da empresa (art.47, caput). Dos diferentes mecanismos criados para reestruturar empresas, destacamos a recuperação extrajudicial, que amplia a margem de atuação de devedor e credores na elaboração do plano de recuperação e restringe a intervenção judicial ao crivo homologatório, cuja natureza é de título executivo judicial. Com a promulgação da lei n.11.232/2005, questionamos o regramento executivo aplicável (cumprimento de sentença, art.475-N, CPC) e a possibilidade de sua constituição via arbitragem.Downloads
