Transnational Conflict Mediation: A Proposal for the Accountability of Digital Companies for Human Rights Violations

Abstract

The digital stage of globalization has driven the formation of networks that transcend state borders, allowing digital companies to surpass the limits of economic expansion and begin to exert influence over culture, politics, and social relations. The operations of the transnational corporations in the digital space create new challenges, especially regarding the protection of human rights, since they operate outside the jurisdiction of national laws. Traditional legal and social science solutions have largely proven ineffective in ensuring the accountability of these companies for rights violations. In light of this, this work proposes mediation as an alternative and effective method to resolve transnational conflicts in the digital environment. Based on the analysis of existing models and concrete cases, it demonstrates how mediation can strengthen the ties between companies and the states in which they operate, promoting accountability and the protection of human rights. It is argued that mediation, by prioritizing dialogue and collaboration, offers more flexible, agile, and fair solutions to contemporary conflicts. The research employs the hypothetical-deductive method, using bibliographic and documentary resources, aiming to contribute to the development of effective mechanisms in global digital governance.
