Criminal administrative law: for a civil police force that is more autonomous in relation to criminal law

Abstract

The treatment given to incidents of minor offensive potential in police stations has not achieved satisfactory levels of performance, because excessive judicialization does not promote social pacification. The objective of the research is to systematize the main ideas that underpin the paths towards a more efficient civil police force outside of criminal law, presenting theoretical elements of criminal minimalism and specifying the material limits to the repressive action of the police apparatus. To this end, an explanatory research was outlined, using documentary and bibliographic sources. The deductive method was used to instigate reflection on the possibility of a more efficient police action based on the promotion of human rights, without using punishment as the goal to be achieved. It is concluded that criminal law needs to be seen as an exceptional measure in conflicts of lesser severity, which is why it is possible to conceive of an administrative criminal law, focused on consensual methods of conflict resolution, which not only better serve the interests of the parties, but also more adequately comply with the principles that govern state action.
