Transnational corporations in the context of the information society in the face of digital crimes

This article examines the role of transnational corporations (TNC) in the digital environment, with the aim of identifying the normative regime of responsibilities of these companies in preventing and combating cybercrime. The methodology is deductive, based on general rules established in the Constitution and in the discipline of Law nº. 9,605/1998. The results demonstrate that digital platforms have the normative duty to safeguard the information society, collaborating with the State in the realization of fundamental rights. Companies that operate in the digital ecosystem must actively assist in the prevention of crimes, in addition to passively complying with determinations of public institutions. This article advocates the polluter-pays principle and the provisions of Law nº. 9,605/1998 for preventing and remedying harmful behaviors in the digital environment.
