Notes on civil justice in Germany: organisation and operation

Abstract

This article provides an overview of the German judicial organisation. The study uses a descriptive and deductive methodology, based fundamentally on a bibliographical review and an investigation of case law and legislation. After understanding the basic concepts of jurisdiction jurisdiction in Germany, it examines the five different specialised jurisdictions. The text also discusses some constitutional rules relating to procedures and the role of judges, as well as making a general analysis of the procedural course in the civil courts of first and second instance. It then examines the work of the Federal Court of Justice and the Federal Constitutional Court. Finally, the comprehensive study of this subject aims to encourage the reader to better understand the German judicial organisation and to identify potential solutions within German law to the challenges currently faced in Brazil.
