Abstract

This paper discusses the possible recognition of constitutional gaps and loopholes, using the perspective of law as integrity. The objective of this study is to deliberate about the connection between constitutional gaps and integrity using a famous legal controversy: the constitutional viability of same-sex unions, decided by the Brazilian Supreme Court on the Direct Unconstitutionality Action No. 4277. Therefore, what we aim to show is that, while examining the issue, the rulings of the Supreme Court´s and other courts were falsely justified based on answers for the constitutional gap, which escaped the limits of appropriate judicial reasoning.
