The Resolution n. 175 of the National Council of Justice Brings changes in Brazilian legal structure and it is necessary to reflect on the legal requirements for the celebration of marriage in Brazil. With this, we suffer changes in concepts of family, stable union and marriage, bringing consequences to the subject of the relationship, generating benefits, rights and obligations other, once that the Resolution authorizes the marriage homoafetivo and, in this way, the conjugal contract brings consequences family relations and economic. The methodology used in this study, regarding the purposes was the qualitative and as means was the bibliographic queries the doctrine, jurisprudence and legislation.
