This article intends to study the influences of thesystem opening of the contract in the promotion of a participativedemocracy. At first, it had been presented a short study aboutthe changes from the closed private law system to the openedone, and the tridimensional law theory. After, it had beenenunciated notions of participative democracy andcitizenship.For last, it have been demonstrated that the systemopening of the contract private law is a powerful tool topromotion of material equality. It had been concluded that theclosed system model makes difficult the access to the minimummaterial goods, what prevents the construction of a DemocraticState of Law.Downloads
