The article deals with the current characteristics ofthe Brazilian system of judicial review, specially the diffusecontrol's abstraction. In order to do that, it studies theunconstitutionality theory, the Brazilian judicial review systemand its mitigation through the "abstraction" which aims to objectthe diffuse control, charging it with the typical effects of theabstract control. Besides evaluating the benefits and drawbacksof this trend, it investigates the binding docket as a proper wayof using it in the Brazilian legal system, and granting the bindingand erga omnes effects to the diffuse control's decisions withoutthe Senate participation.Downloads
