Abstract

This scientific article demonstrate the manner like the means of communication are using the prerogative from the prohibition of the censure present in the Brazilian Constitution to guarantee the freedom of the journalistic information, to manipulate suits , to impose opinions and to influence the population. Therefore, the media when report criminal events, infract others constitutionals guarantees, to invade the privacies, to suppose blame and to decree innocences. It provoke a bump of the fundamental rights that only obtain harmony with Proportionality principle, the one depend of the concretion case.
