Abstract

On December 8^th, 2004, Brazilian’s House of Representatives and Senate promulgated the Forty-fifth Brazilian Constitutional Amendment that brought changes on the Judiciary. This essay proposes a rereading of that Amendment in its 10^th anniversary, reopening and making deeper the debate about the constitutional hierarchy of the human rights treaties in Brazilian law, through analysis of the paragraphs of the 5^th article of the Constitution and of the original intentions of reformers constituents on introducing them to it.
