Abstract

For Dworkin, a way to overcome the tension between legal certainty and fair decision lies in building a constructivist theory of duty reducing judicial discretion by rational decisions based on existing law. For such an undertaking, the author criticizes the theories of the most prominent law in contemporary times, pointing out the failures and solutions that intends to pursue through its alternative theory.
