Abstract

The work deals with the controversial subject of relativity of res judicata in collective actions. At first, it tries to clarify the concept of collective rights. The second part is devoted to res judicata followed by discussion about legal certainty. After weaving just genaral observations about the formation of res judicata in individual conflicts was analyzed more deeply the various specificities of collective res judicata as well as the discussion on the posibility to relativize the res judicata in such actions.
