Abstract

This article analyzes the institution of presidential reelection in Brazil, contextualizing its inclusion in the 1988 Constitution and its consequences for democratic stability. The study aims to verify whether reelection contributes to or hinders the alternation of power, which is essential for the functioning of modern democracies. The methodology employed combines bibliographic and documentary research with a comparative analysis of political systems in countries that have adopted or abolished the institution, assessing the impacts of this practice on governance and institutional balance. In addition, issues such as the benefits and risks associated with reelection, such as the continuity of public policies and the risk of personalization of power, are addressed. The results indicate that, although widely used in democratic systems, reelection can generate electoral imbalances, favoring the incumbent and hindering the competitiveness of the electoral process. Such imbalances result in a concentration of power that compromises alternation, a key element for democratic legitimacy. It is concluded that presidential reelection in Brazil requires constitutional review to mitigate inequalities and strengthen democratic institutions, and it is recommended that reflection be given to alternative models that ensure greater balance and impartiality in the electoral system.

Lawyer (Prates Advogados Associados) graduated in (1995), with a master's degree in Criminal Sciences and a doctorate in Social Work from the Pontifical University of Rio Grande do Sul, Full Professor at PUCRS linked to the School of Law, Coordinator of the Procedural Practice Center. Supervisor of the Free Legal Advisory Service at PUCRS, Supervisor of Internships at PUCRS, Supervisor of the Small Claims Courts at PUCRS. Supervisor of the Consumer Service Desk at PUCRS, Supervisor of Immigrant Services at PUCRS. Professor of law, criminal procedure and professional initiation and judicial organization at the Pontifical Catholic University of Rio Grande do Sul. Develops legal activities in the civil and criminal fields. He is the author of the work Community Service and the Juvenile Offender and co-author of the work Contemporary Criminal Policies. He is the Deputy Coordinator of the Study Group on Marxist Theory and Public Policies GTEMPP - linked to CNPq and the School of Humanities at PUCRS.
