The principle of acess to justice: expanding pleading capacity

In Brazil, everyone has procedural capacity, but pleading capacity is exclusively reserved for attorneys – thosewho have law degrees and passed the national bar exam. Having said that, there are hypotheses where normal citizens
have pleading capacity, such as in cases of labor complaints, habeas corpus,small causes (special courts) as well as´specific exceptions established by the Brazilian Code of Civil Procedure. As arule, it establishes that plaintiffs do not have the right to plead their own case before the Judiciary. Nonetheless, in
order to expand access to justice, this new groundbreaking law allows ordinary citizens to plead their own cases as a means of exercising citizenship rights and democracy. Moreover, it is a solution substantiated on the principle of instrumentality of the legal process and is a resolution for the precarious legal
assistance of Public Legal Defenders, offered by the Brazilian State, whose service marginalizes thousands of Brazilians from access to the judiciary. This research utilizes the qualitative
analysis method with the hypothetical-deductive method of escriptive and analytical approaches, aiming to advocate for adequate standard proceedings where pleading capacity is not exclusive to lawyers but to everyone who seeks the judiciary.
