Caráter, finalidade e importância do direito agrário

Abstract

With agrarian activity, which antecedes comercial-industrial activities, there were developed the legal norms and principles that regulate societies and social progress. In this work the character, purpose and importance os agrarian law is demonstrated, and an attempt is made to relate it to the land and its products together with the controls Nature imposes over humans. The origin and development of agrarian law are directly related to law and is seen as a universal phenomenon. The character, purpose, and importance of agrarian law depends on the form by which property law, concerning land, is part of legal ordination subject to the influence of the preponderance of agrarian and industrial activity. In Brazil, considering the significance of agrarian activity for the nation, the importance of human work with the land, producing the basic elements of survival of all and serving as pedestal for other economic activities, infers an incontrovertible and tranquil importance and purpose for agrarian law. 18 is justified, therefore, the considerations developed in this work, concerning a theme so exciting for Brazilian reality.
