Abstract

The article analyzes the reasons why Kelsen wanted to format a legal science and the criteria and concepts used in this endeavor. Concepts are considered as legal norm and legal proposition, causality and imputation, static and dynamic legal, in addition to the role of the Fundamental Standard in the logical structure of the legal system according to the Pure Theory of Law. They are analyzed also the connections between law, justice and legal science according to Kelsen. Finally, it is intended to point out that the legacy of the Pure Theory of Law.

Author Biography

José Ricardo Alvarez Vianna, Faculty of Law, University of Lisbon.

He graduated in Law from the State University of Londrina (1993) , Master of Negotiation Law from Universidade Estadual de Londrina (2002) , with the Civil Liability dissertation for Damage to the Environment . Currently pursuing PhD in Law School - University of Lisbon (FDUL) in Portugal. He is also coordinator / professor in the School of Magistrates of Paraná - Londrina Center; professor at the School of Public Prosecution Foundation (FEMPAR) - nucellus Londrina, a professor at the School of Law (ESA) - Regional Londrina ; professor at the Institute of Constitutional Law and Citizenship (CPIC); professor at the State University of Londrina (UEL) in the course of specialization, and Judge in Paraná since 1998. Before that he was Promoter of Justice, also in Paraná, between 1996-1998; and Lawyer, between 1994-1996.
