Abstract

This study focuses on the problematic topic of the ‘right to be forgotten’, while analyzing it alongside current perspectives of existing advances in information and communication technology. Moreover, this paper explores this right´s origin, its object of protection, and its pertinence as an autonomous right in the Brazilian legal system. Therefore, using the inductive approach, this body of research examines various court cases, which are considered the leading cases of this field, subsequently analyzing law books´ definitions of the right to be forgotten. In conclusion, this study verifies that the indexation problematic was a great innovator on this subject and in the context of the right to be forgotten, which, despite not being a new right, sustains new meaning in modern day law.
