Abstract

You can have “ access to justice “ and not have access to the process ? Although seemingly contradictory questioning , their understanding requires the revisiting the perspective of the welfare state , in line with the design of Florence and a fourth wave renewals , to finally get consistent theoretical basis with the constitutional March 1988 , the paradigm of democratic state . To do so , leaving the essential theory of the legal relationship of the process structured around the court , standing as a counterpoint to the theory of the process as adversarial procedure completed as a first step . In democratic line must ensure that the recipient of the state act is seen as co-author in the construction of this act , from the perspective of Habermas, a condition that is not met by adopting the relationist theory.
