Abstract

The work is a substantial study of the institutes introduced the managerial reform of the state, covering initially a historical overview, for, as a result, to delve into each of the existing contractual arrangements. The author is optimistic regarding the management model, however, it is firm in emphasizing the need for caution in the use of instruments. At some points, however, the positioning of the author, going against some renowned patriotic lawyers, such as Celso Antonio Bandeira de Mello, which makes severe criticism of the management reform, therefore, understands that although the state is admittedly a bad service is even worse when acting as an oversight entity. The issue is controversial and very current, and, therefore, is treated with particular caution by the author, which holds its position without attacking those who come to reform as a kind of loss of government reins.
