Environmental impact assessment and administrative discretion: a hydroelectric power plant Mauá

Abstract

Check and compare the doctrinal positions on the existence of discretion or linking of the Government with respect to the results of the environmental impact assessment when it is required in the environmental licensing. The results confirmed the existence of administrative discretion in the granting of environmental licenses, demonstrating that it is present in the law to ensure fair and correct decisions in individual cases, which put into practice the meaning of sustainable development.
