Abstract

The court injunction granted in the federal constitution of 1988 to enable the exercise of fundamental rights constitutionally defined, but hampered by the lack of a regulatory provision, it can be glimpsed as a possibility for realization of fundamental social rights whereas such rights don't have a positive act of the judiciary to promote the realization of social citizenship. It is up to the judiciary to departs from the extremely attachment to the principle of separation of powers, of its self-restriction posture and obstacles presented by budget limitations and work to promote the justiciability of fundamental social rights, so, such rights can be effected in social reality. One way to enable the realization of fundamental social rights in brazilian society is the judiciary, especially in the figure of the Supreme Court, prioritize the good management of the court injunction, enabling this constitutional remedy actually provides to your petitioner the enjoyment of right hitherto hindered by legislation omission.
