Micro and small businesses play a fundamental role in Brazil’s economy. This study examines their concepts, parameters, and importance in fulfilling their social duties in their communities. For this purpose, this study explores the normative instruments that justified the different legal treatment given to these entities, specifically until the promulgation of Law nº 123/2006. From an economic standpoint, micro and small companies contribute immensely to the development of Brazil, as they provide formal jobs and stimulate consumption. However, from a constitutional perspective, the meaning of social duty is diluted in the context micro and small businesses. This paper is exploratory in nature and utilizes data collection from scientific articles that also analyze this subject from historical and descriptive methods.Downloads
