Abstract

The public administration in Brazil, which legal framework is formed by the constitutional amendment n. 19/98, opened spaces discussing the need to establish a new managerial mode in the public sector, specifically with the decentralization of State activities. Additionally, it currently controls administrative actions, analyzes civil servant activity and, among others, prioritizes alternative dispute resolution mechanisms for problems derived from the execution of administrative contracts. Although the reform promoted State efficiency beginning with the Brazilian State, there are still many challenges that need overcoming as a means to continue the implementation of efficient managerialism. Furthermore, this paper verifies, from the deductive-critical method, the challenges that the Brazilian State faces so that the public administration may triumphantly overcome them. Finally, this research is derived from a master’s thesis submitted to the Master's program in Negotiation Law of the State University of Londrina.
