Environmental civil liability: understanding sustainability, compensation and prevemention

Abstract

This paper has the central objective of analyzing civil liability in light of current paradigms, characterized by technological progress and mainly by environmental deterioration. Therefore, under the guise of sustainability, this study searches for instruments as a means of repairing environmental damages. One such instrument is law, which is a mechanism that can organize solutions and administrate controversies. Moreover, it has the important function of answering such challenges. Finally, this paper utilizes juridical-sociological concepts, literature review of jurisprudence, with the objective of better understanding this important issue.
